What is Different about ADA Expertise Consulting, LLC?

There are plenty of "ADA consultants" out there. And state and local governments with more than 50 employees have been required to have an ADA Coordinator on board for decades. Why engage us?

We know the ADA and other federal civil rights laws prohibiting discrimination on the basis of disability because we helped develop the Justice Department's enforcement positions and technical assistance. How many other ADA consultants have that background?

ADA Expertise Consulting, LLC can assist you with all of your ADA compliance needs - we have expertise in all aspects of the ADA, and have a unique background - experience enforcing the ADA on behalf of the United States Department of Justice, and collaborations with the top ADA experts in the country.

Our founder, Marc Dubin, Esq., has worked with the ADA since the year the ADA went into effect, having served as a Senior Trial Attorney at the Justice Department, in the Disability Rights Section of the Civil Rights Division, from 1992-2005.

On behalf of the Justice Department, the agency that wrote, interprets, and enforces the ADA regulations, he was responsible for nationwide education about and enforcement of the ADA and Section 504. He helped decide which investigations to open, helped write the technical assistance, trained nationally about the ADA, and was responsible for the first ADA case ever filed by the Justice a Department. Many of his cases at the Justice Department served as models for future federal investigations.

ADA Expertise Consulting, LLC provides comprehensive guidance to businesses and state and local governments, addressing all aspects of the ADA. Our goal is to help you enhance your services to the disability community, and help you avoid litigation and federal enforcement efforts. We can provide you with confidential trainings and assessments to allow you to address whatever problems we identify.

Our nationwide consulting firm collaborates with other experts, to address website accessibility, policy modification requirements, effective communication requirements, architectural requirements, and requirements imposed by the Fair Housing Act and Section 504 of the Rehabilitation Act of 1973.

We enhance the ability of businesses and state and local governments to avoid litigation and federal investigations and to come into voluntary compliance with the law. We provide confidential testing, assessment, and policy development, and provide comprehensive, confidential reports.

Marc also served as Director of Advocacy for a nonprofit organization in Miami Dade County for a decade, assisting businesses, state and local government officials, and ADA Coordinators enhance their compliance with the law. He understands the perspective of businesses and state and local government officials, and understands the perspective of the disability community. He understands the value of education and preparation.

For decades, he has provided businesses and state and local governments alternatives to litigation, working with businesses and state and local governments collaboratively, by providing high quality education and training. He has been a member of an Advisory Panel assisting Florida's Department of Children and Families (DCF) enhance service to the deaf and hard of hearing communities, and is a widely sought-after speaker and trainer. He has often been sought out by the media for his expertise and guidance, and has appeared on television and in newspapers.

Marc established ADA Expertise Consulting to provide businesses and state and local governments with access to the information and resources they need to understand and comply with the Americans with Disabilities Act (ADA) and other federal civil rights laws prohibiting discrimination on the basis of disability. We seek to increase voluntary compliance, and collaborate with other experts across the nation, to provide you with all the services you need to comply with the law.

Marc Dubin was one of the first attorneys hired by the Justice Department after the passage of the ADA, and from 1992-2005, was responsible for nationwide education about and enforcement of the ADA and of Section 504 of the Rehabilitation Act of 1973. He not onlylearned the law at the Justice Department, alongside other Justice Department attorneys and architects, he taught architects, business owners, ADA Coordinators, lawyers, and state and local governments about the ADA, nationwide, for over a decade, on behalf of the United States.

Understanding the requirements of the ADA, Section 504 of the Rehabilitation Act of 1973, and the Fair Housing Act is essential, and we are here to help. Discrimination on the basis of disability is rarely intentional – most violations occur due to a lack of understanding of the law's requirements.

ADA Expertise Consulting provides confidential guidance to help businesses and state and local governments avoid litigation, and to understand the ADA regulations issued by the JusticeDepartment, including the newest regulations issued in 2010, regulations that are now in effect.

Businesses that serve the public, of any size, have a variety of responsibilities under the ADA, including:

Modifying policies and practices that discriminate against people with disabilities,

Complying with accessible design standards when constructing or altering facilities,

Providing accessible websites.

Removing barriers in existing facilities where readily achievable, and
Providing appropriate auxiliary aids and services when needed to ensure effective communication to people who have hearing, vision, or speech impairments.

Landlords are covered by the Fair Housing Act, and are required to make accommodations for tenants with disabilities, including allowing tenants with disabilities to have a service dog or emotional support animal, even when a lease prohibits pets. We provide guidance about the Fair Housing Act and the ADA to landlords, condominium associations, Public Housing Authorities, and Homeowner Associations. Our work can prevent costly lawsuits and federal investigations.

Our work can also help increase the income of businesses, by enhancing services to customers with disabilities.

According to the Justice Department:

“More than 50 million Americans with disabilities - 18% of our population - are potential customers for businesses of all types across the United States. This group has $175 billion in discretionary spending power, according to the U.S. Department of Labor. That figure is more than twice the spending power of American teenagers and almost 18 times the spending power of the American "tweens" market. Accessibility attracts not only people with disabilities but also their families and friends. Like others, these customers often visit stores, restaurants, movie theaters, and other businesses accompanied by family or friends. This expands the potential market exponentially. This market is growing fast. By the year 2030, 71.5 million Baby Boomers will be over the age of 65 and demanding products, services, and environments that address their age-related physical changes.”

We can assist you in assessing your website to determine if it is fully accessible to guests with disabilities, including customers who are blind or deaf, and we can provide solutions to bring your website into compliance. Even if your facility is not yet accessible, making your website accessible can serve customers with disabilities, and increase your sales. We can help you assess your compliance priorities.

We can assist you in assessing your policies concerning the admission of guests accompanied by a service dog, and train your staff how to identify a service dog, what questions they are permitted to ask, and what can be done if a service dog misbehaves. We can also help develop lawful service dog policies for your business and provide training to your staff.

We can assist you in complying with the architectural obligations imposed by the ADA, and train your architect and lawyer about what the ADA requires. It is important to recognize that the ADA is a federal civil rights law, not a building code, and that permits issued by a local building code official do not guarantee compliance with the ADA.

We can assist you in complying with the effective communication obligations of the ADA, and train your staff about when you are required to provide a sign language interpreter and when you are not.

We can provide comprehensive training to your staff, and assist you in marketing to the disability community.

We can assist state and local governments in keeping your Self Evaluations and Transition Plans up to date, and train your ADA Coordinators.

We can keep you informed of Justice Department actions, and provide guidance and training about the new ADA regulations issued by the Justice Department in 2010.

Ii is our view that far too many businesses have been subjected to unnecessary ADA litigation, and that through our services, businesses can not only avoid litigation, but can vastly improve their ability to serve the disability community, and thereby tap into the incredible spending power of the disability community.

We also assist state and local government officials. We assist in developing Self-Evaluation Plans and Transition Plans, and train ADA Coordinators. We have expertise in the new title II and title III regulations.

The new regulations are comprehensive and complex, and we offer state and local government officials guidance in updating their Self-Evaluations and Transition Plans. Please consider allowing us the opportunity to be of assistance. Contact us to discuss what we can do for you.
